LATEST UPDATES ON NEW RULES REGARDING CMS AND HCPF
As many are aware, there are changes afoot in the Developmental Disabilities system brought about by the impacts of compliance with the new federal Centers for Medicaid and Medicare Services (CMS) requirements and the involvement of state Health Care Policy and Financing (HCPF). There are also changes regarding the transfer of Part C activities.

Effective July 1, 2006, all clients and applicants who are experiencing Medicaid or CHP+ problems because of CBMS that cannot be resolved by the county or medical assistance site are being directed to call the Department's Customer Service at 1-800-221-3943 or, for the Denver Metro Area, 303-866-3513.

Part C Changes
Colorado Governor Bill Owens signed an executive order on December 30, 2005 changing the Lead Agency for Part C from the Colorado Department of Education to the Department of Human Services. This means that effective July 1, 2006 Kids Connections will no longer be the organization to administer the IDEA, Part C funds in Boulder and Broomfield counties. That responsibility will be assumed by Imagine!.
The transfer of Part C from education to DDD continues with ever changing issues. Our local communication and cooperation has been excellent, but new twists continue to arise. We have expressed our concerns with the proposed budget submitted to the Office of Special Education Programs (OSEP-federal) by DDD and the allocation of funds to our community. We need to make sure that our funding levels enable us to maintain the service coordination efforts that we have in place in our community. DDD has indicated that we should have flexibility to move dollars from direct services to service coordination if needed. We must have this flexibility or the transfer will not work. The proposed methodology for the allocation of new Early Intervention (EI) resources to our community shows an increase for our community, but issues around “child find” have put these new service dollars at risk.
It was expected that the 613 new resources would go to cover the over service in each community. “Equity” has now been attached to the allocation methodology, and the State’s plan looked at the EI resources in the aggregate - State Developmental Disability EI funding, Part C funding, and the new EI resources - and redistributed on the basis of “identified need”. This method would have reduced the current level of funding to some communities. They are seeking some additional dollars to be able to do a “hold harmless” for those communities this year.
Most recently the issue of which entity is responsible for “child find” or “child identification” has surfaced. Historically, the school districts have conducted the screenings and evaluations of children birth through their 3 rd birthday suspected of a developmental delay or developmental disability. The schools have been told that this is no longer their responsibility. DDD has sought clarification from the Colorado Attorney General’s Office, and the Office of Special Education Programs in Washington. And the CCB’s have not been told that there are new dollars available to fund these services (at least as of this date). This could be a significant cost to Imagine!, and we are in conversation with our local school districts on this matter, and will be seeking funding from the State.
