The Office of Public Guardianship Pilot Program
The bill creates the office of public guardianship within the judicial department to provide legal guardianship services to indigent and incapacitated adults who:
- Have no responsible family members or friends who are available and appropriate to serve as a guardian;
- Lack adequate resources to compensate a private guardian and pay the costs and fees associated with an appointment proceeding; and
- Are not subject to a petition for appointment of guardian filed by a county adult protective services unit or otherwise authorized by law.
Shari D. Caton is a founding member of Poskus, Caton & Klein, P.C. and recent appointee to the Office of Public Guardianship Commission. She practices in the areas of estate litigation, estate planning, disability planning, public benefits, probate, wills and trusts, guardianships, and conservatorships. She is a Fellow of the Colorado Bar Foundation and a member of the Colorado Supreme Court Probate Rules Committee. Ms. Caton is a current member of the CBA Elder Law Section executive council and previously served as council chair. She also served as the Elder Law Section Office of Public Guardian committee chair. She is the managing co-editor and an annual contributor to CBA-CLE’s Elder Law in Colorado and contributor to the Colorado Senior Law Handbook. Ms. Caton is licensed to practice in the State of Colorado, the U.S. District Court for the District of Colorado, the State of New Mexico, and the U.S. District Court for the District of New Mexico. She is also a current member of the National Academy of Elder Law Attorneys and the American, Colorado, New Mexico, and Douglas County bar associations.
